Terms of Service

These Terms of Service govern the use of the Now & Then service. Using the Service constitutes agreement to these terms and to the Privacy Policy. The Service provides private, closed infrastructure for graduating-class communities — it is not an open social network and not a venue for publishing content to the public.

1. The Service

The Service lets a class organizer set up a private site for their class community, upload the yearbook, and invite classmates; and lets members find their card, claim it with explicit consent, add content and reconnect.

Access to each community site is limited to members of that class only, by invitation or by a class link subject to organizer approval. Sites are not publicly accessible and are not indexed by search engines.

2. Accounts and conduct

The Service is for adults (18+) only. You must provide accurate details at signup; impersonating another person or claiming a card that is not yours is prohibited.

Uploading abusive, harassing, unlawful or rights-infringing content is prohibited, as is any use of the Service beyond its purpose — reconnecting a class community.

3. Organizer attestation and responsibility

An organizer who uploads a yearbook or a member roster hereby affirms and undertakes: (a) that they are entitled to upload the material; (b) that everyone appearing in it is an adult today; and (c) that they understand they bear responsibility for any infringement of third-party rights arising from the upload.

The organizer controls the community's content: they decide who is invited and admitted, may delete content — including the original yearbook pages — or the entire community, and must handle removal requests addressed to them.

4. User content and ownership

Content you upload remains yours. By uploading it you grant the Service a limited license to display it within the class community only, for the purpose of operating the Service.

Whoever uploads a photo — including a group photo in which others appear — affirms that they are entitled to upload it and that doing so does not infringe the rights of the people depicted. Any person appearing in content may report it and request its removal, with or without an account, and the request will be handled promptly.

We may remove infringing or abusive content, on our own initiative or following a report.

5. Prohibited uses

Copying, publishing or distributing community content outside the community — including screenshots of other members' photos or details — without their consent is prohibited.

Scraping, bulk downloading of content, automated use of the Service, and attempts to bypass access controls or cross-community isolation are prohibited.

Uploading content of present-day minors is prohibited; the Service is for communities whose members are all adults today.

6. Paid and future features

Some capabilities are or will be offered for a fee. Price, billing terms and cancellation policy will be shown explicitly before any charge.

AI photo-enhancement features and export features (such as a downloadable keepsake book) are conditional on separate, explicit consent of the people depicted, and will operate only subject to it. These features are currently off.

7. Removal, suspension and termination

A member can release their card or delete their account at any time; a person appearing in a photo can request removal even without an account.

An organizer may close their community; closing it deletes its content. We may suspend or remove an account or community that violates these terms, with notice where feasible. A member blocked from a community may appeal from within the Service.

8. Liability and indemnity

Community content is uploaded by organizers and members, and responsibility for it — including for third-party rights — rests with whoever uploaded it. An uploader undertakes to indemnify the Service for any claim arising from breach of their affirmations.

The Service is provided as-is. We do not warrant uninterrupted availability, and our aggregate liability is limited to the amounts paid to us in the twelve months preceding the event. Nothing here derogates from liability that cannot be limited by law.

9. Governing law, jurisdiction and supported regions

These terms are governed by the laws of the State of Israel, and the competent courts of Israel have exclusive jurisdiction. The Service is operated by an Israeli company.

The Service is currently intended for users in Israel and the United States and is not directed at other markets, including the European Economic Area.

10. Changes and contact

We may update these terms; a material update will be published on this page with its date. Continued use after an update constitutes agreement to the updated text.
